These Terms & Conditions ("Terms") govern purchases made by consumers in the United States, Canada, and Mexico through the VitaJuwel online store at www.vitajuwel.com, as well as their use of the website.
Please read these Terms carefully before placing an order.
By placing an order and accepting these Terms at checkout, you agree to their provisions, subject to applicable consumer protection laws.
Nothing in these Terms excludes, restricts, or modifies any consumer rights or remedies that cannot lawfully be excluded, restricted, or modified.

Throughout these Terms, "VitaJuwel," "we," "us," and "our" refer to VitaJuwel USA, Inc.
VitaJuwel USA, Inc. is the seller and contracting party for all consumer purchases covered by these Terms.
2. Scope and Acceptance of Terms
These Terms apply to purchases made primarily for personal, family, or household use and delivered to addresses in the United States, Canada, or Mexico.
Purchases made for resale or through an approved business account are subject to our separate Wholesale Terms & Conditions.
Additional conditions may apply to certain products, services, or promotional offers. Such conditions will be disclosed where applicable and form part of the relevant transaction, to the extent permitted by law.
Country-specific provisions for Canadian and Mexican consumers are included in Sections 20 and 21. Where these provisions conflict with the general Terms, the applicable country-specific provisions prevail.
3. Eligibility and Customer Accounts
To place an order, you must be at least 18 years old or have reached the age of majority in your jurisdiction, whichever is higher.
You agree to provide accurate and complete information when placing an order or creating a customer account.
You are responsible for maintaining the confidentiality of your account credentials and for notifying us promptly of any suspected unauthorized access.
Guest checkout may be available without creating an account.
We may suspend or restrict accounts reasonably suspected of fraudulent, unlawful, or unauthorized activity, subject to applicable law and without affecting existing consumer rights.
4. Products and Product Information
We make reasonable efforts to ensure that product descriptions, images, specifications, and availability information are accurate and up to date.
However, minor differences may occur between the appearance of products displayed online and the products delivered.
Many VitaJuwel products incorporate natural gemstones or handcrafted glass components. Natural variations in gemstone color, size, shape, texture, and arrangement, as well as minor handcrafted variations, are characteristic of these products and do not, by themselves, constitute defects.
Occasionally, gemstones may rest within the narrow stem of a gemstone vial or droplet. This is not considered a manufacturing defect if it does not interfere with the product's intended use.
Product dimensions, weights, and capacities may be approximate unless expressly stated otherwise.
These provisions do not affect your rights if a product is defective, materially different from its description, or otherwise fails to meet applicable legal requirements.
We reserve the right to modify or discontinue products, provided such changes do not improperly affect orders already accepted.
5. Prices, Currency, and Taxes
Product prices are displayed in the currency applicable to your selected market, as determined by our online store settings.
Depending on your location, prices may be displayed and charged in US dollars or another supported currency.
The final transaction currency and total amount payable, including applicable taxes and shipping charges collected by VitaJuwel, will be disclosed before you confirm your order.
Your bank or payment provider may apply additional currency conversion charges or international transaction fees beyond our control.
Prices may change without notice. However, price changes will not affect purchases already concluded at an agreed price.
Applicable sales taxes and other taxes collected by VitaJuwel will be calculated and disclosed in accordance with applicable law.
For cross-border orders, customs duties, import taxes, brokerage fees, or similar charges may apply. Responsibility for these charges depends on the shipping arrangement disclosed at checkout.
Where import charges are collected in advance, they will be identified as part of the checkout process. Where charges are payable upon import or delivery, the applicable arrangement will be disclosed before purchase as required by law.
6. Orders and Contract Formation
You will have an opportunity to review your order details and correct errors before submitting your purchase.
By placing an order, you request to purchase the selected products under the conditions presented at checkout.
We will send an electronic acknowledgment containing relevant order information.
To the extent permitted by applicable law, an automated order acknowledgment does not by itself constitute acceptance, and VitaJuwel may review an order before confirming acceptance.
An order will be accepted when we send a shipping confirmation or otherwise expressly confirm acceptance, unless a binding contract has already been formed under applicable law.
Before a contract is formed, we may decline an order for legitimate reasons, including suspected fraud, inability to authorize payment, or genuine product unavailability, subject to applicable law.
Once a binding contract has been formed, cancellation or modification by VitaJuwel is subject to the agreement and applicable consumer protection requirements.
If we cancel an order and have already collected payment, we will provide the refund required by law.
We will not charge a higher price than the amount accepted by the customer without express agreement.
7. Payment
We accept the payment methods displayed at checkout. Available payment options may vary by country, currency, or transaction.
By placing an order, you confirm that you are authorized to use the selected payment method.
Payments may be processed by Shopify Payments or other authorized payment service providers.
If payment authorization fails, we may request another payment method or decline the order before a binding contract is formed, subject to applicable law.
Nothing in these Terms limits your legally available rights to challenge unauthorized or incorrect charges.
8. Shipping and Delivery
We ship to the destinations and addresses made available through our online checkout.
Available shipping methods, charges, and estimated delivery times will be disclosed before you complete your purchase.
Delivery estimates are provided in good faith and are not guaranteed unless expressly identified as guaranteed delivery dates.
We will make reasonable efforts to ship orders within the time indicated and comply with applicable laws regarding shipping promises, delays, customer notifications, and refunds.
If we cannot ship within the promised or legally applicable period, we will provide the required notice and offer customers the applicable options concerning delayed shipment, cancellation, and refunds.
Tracking information may be provided once an order has shipped.
Risk of loss or damage passes to the customer only as permitted by applicable law.
If an order arrives damaged, incomplete, incorrect, or does not arrive, please contact contact@vitajuwel.com so we can investigate and arrange an appropriate remedy.
For cross-border deliveries, customers may be required to provide reasonable information or assistance for customs clearance. Any related charges will be handled according to the arrangement disclosed at checkout and applicable law.

9. Returns, Cancellations, and Refunds
9.1 Final Sale Policy
Unless expressly stated otherwise for a particular product or promotion, all sales are final, subject to applicable law.
VitaJuwel does not offer voluntary returns, exchanges, or refunds for non-defective products solely because a customer changes their mind, no longer needs the product, or would prefer a different item.
Please review your product selection, gemstone blend, color, quantity, and delivery details carefully before completing your purchase.
9.2 Mandatory Consumer Rights
Our Final Sale Policy does not override any statutory rights to cancel an order, return a product, obtain a refund, or receive other remedies under applicable consumer protection laws.
This includes applicable federal, state, provincial, and Mexican consumer protection requirements.
9.3 Defective, Damaged, or Incorrect Products
If you receive a defective, damaged, or incorrect product, please contact us at contact@vitajuwel.com.
Include your order number, a description of the issue, and photographs where reasonably available.
We will assess the issue and provide an appropriate remedy in accordance with our warranty obligations and applicable law.
Depending on the circumstances, this may include repair, replacement, refund, or another legally required remedy.
9.4 Order Cancellations
If you wish to cancel an order before shipment, please contact us as soon as possible.
We will review cancellation requests, but cannot guarantee that an order can be canceled once processing or fulfillment has begun.
This does not limit statutory cancellation rights or legally required remedies for delayed or unfulfilled orders.
9.5 Refunds
Approved monetary refunds will ordinarily be made to the original payment method unless another arrangement is agreed upon or required by law.
Refund processing will comply with applicable legal requirements.

10. Warranty and Worry-Free Replacement
VitaJuwel stands behind the quality and craftsmanship of its products with two distinct customer protection programs.
10.1 Two-Year Limited Warranty
VitaJuwel provides a 2-Year Limited Warranty covering qualifying defects in materials and workmanship under normal household use.
The warranty applies to eligible new products purchased directly from VitaJuwel or from authorized VitaJuwel retailers in the United States, and to eligible products purchased directly through vitajuwel.com by consumers in Canada and Mexico.
Warranty coverage, eligibility requirements, exclusions, claim procedures, and available remedies are described in our separate VitaJuwel 2-Year Limited Warranty Policy.
10.2 Five-Year Worry-Free Replacement Policy
Accidents happen. Customers who accidentally damage an eligible VitaJuwel product purchased directly through vitajuwel.com, vitajuwel.us, or a qualifying successor VitaJuwel-operated US online store may be eligible for our voluntary 5-Year Worry-Free Replacement Policy.
For an approved claim, VitaJuwel issues a VitaJuwel Gift Card equal to 50% of the current manufacturer's suggested retail price (MSRP) of an eligible replacement product at the time the claim is processed.
The policy applies to qualifying direct consumer purchases in the United States, Canada, and Mexico.
The benefit is separate from the 2-Year Limited Warranty, is intended for eligible accidental damage rather than manufacturing defects, and is subject to the eligibility requirements, exclusions, claim procedures, and limitations described in the separate VitaJuwel 5-Year Worry-Free Replacement Policy.
10.3 Claims and Customer Support
Warranty or Worry-Free Replacement inquiries may be submitted to contact@vitajuwel.com.
Customers should include their order number or purchase receipt, a description of the issue, and photographs where reasonably available.
Do not return damaged or defective products unless instructed to do so by our customer service team.
10.4 Statutory Consumer Rights
Both programs are provided in addition to, and do not replace or limit, any statutory warranties, consumer guarantees, or other mandatory rights and remedies available under applicable law.
11. Product Use, Care, and Safety
VitaJuwel products must be used in accordance with their intended purpose and the applicable care and safety instructions.
Many VitaJuwel products contain glass components and natural gemstones and should be handled with appropriate care.
Do not continue using cracked, broken, or otherwise unsafe glassware.
Sealed gemstone modules and vials must not be opened or altered. If a sealed component becomes damaged, discontinue use and contact customer service.
Only use compatible accessories and replacement components where specific compatibility requirements apply.
VitaJuwel products are not medical devices and are not intended to diagnose, treat, cure, or prevent diseases.
Information regarding gemstones, historical traditions, energy, or wellness is provided for general informational purposes and is not a substitute for professional medical advice.
Nothing in this section limits any non-waivable consumer rights or product liability protections.
12. Intellectual Property
The VitaJuwel website and its content, including photographs, text, product designs, trademarks, logos, graphics, and videos, are owned by or licensed to VitaJuwel and protected by applicable intellectual property laws.
You may access and use our website for lawful personal and non-commercial purposes.
You may not reproduce, commercially exploit, distribute, or misrepresent VitaJuwel content without prior authorization, except as permitted by law.
Purchasing a VitaJuwel product does not transfer ownership of any intellectual property rights.
13. Customer Reviews and Submitted Content
If you submit customer reviews, photographs, comments, or other materials through our website, you agree that the content is genuine and does not infringe third-party rights or violate applicable law.
You retain ownership of your submitted content.
By voluntarily submitting content for publication, you grant VitaJuwel a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and distribute that content in connection with operating our website and promoting our products, subject to applicable privacy, publicity, and consumer protection laws.
Where additional consent is required, we will obtain it before using the relevant content.
We may moderate or remove unlawful, fraudulent, infringing, or abusive content in accordance with our published review guidelines.
We do not prohibit genuine negative reviews merely because they are unfavorable to VitaJuwel.
Material connections, incentives, or sponsorships associated with submitted reviews must be disclosed where required by law.
14. Acceptable Website Use
You agree to use our website lawfully and refrain from activities that interfere with its security or operation.
Unauthorized account access, fraudulent transactions, malicious software distribution, and attempts to circumvent website security measures are prohibited.

Nothing in these Terms restricts lawful consumer complaints, truthful reviews, or other legally protected activities.

Our website may rely on third-party service providers for payment processing, ecommerce functionality, delivery tracking, customer reviews, and other business functions.
Third-party services may be subject to their own terms where applicable.
Links to external websites are provided for convenience and do not necessarily indicate endorsement.
Information about how VitaJuwel collects, uses, and protects personal information is available in our Privacy Policy.
Nothing in these Terms limits privacy rights provided by applicable law.
16. Disclaimers and Limitation of Liability
We make reasonable efforts to maintain an accurate, reliable, and secure website, but cannot guarantee uninterrupted availability or the absence of technical errors.
To the maximum extent permitted by law, the website and its non-product-related informational content are provided on an "as available" basis.
Nothing in these Terms disclaims our express warranties, mandatory implied warranties, applicable statutory guarantees, or any other non-waivable consumer rights.
To the extent permitted by applicable law, VitaJuwel will not be liable for indirect, incidental, special, or consequential losses arising solely from ordinary website interruptions or circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability for personal injury, product liability, fraud, intentional misconduct, or any other liability that cannot legally be excluded or restricted.
All disclaimers and limitations must be interpreted consistently with applicable consumer protection laws.
17. Dispute Resolution and Governing Law
17.1 Customer Support
We encourage customers to contact contact@vitajuwel.com with any questions, complaints, or concerns.
We will make reasonable efforts to resolve disputes fairly and promptly.
Contacting customer service is not a mandatory prerequisite to exercising legal rights or filing a claim.
17.2 Governing Law
Except where mandatory consumer protection laws require otherwise, these Terms and disputes arising out of or relating to them are governed by the laws of the State of New York, United States, without regard to its conflict-of-law principles.
Nothing in these Terms deprives consumers of mandatory rights or protections under applicable laws in their jurisdiction.
17.3 Jurisdiction
Subject to applicable law and any non-waivable rights to bring proceedings elsewhere, disputes relating to these Terms may be brought before courts of competent jurisdiction in New York.
Consumers in Canada and Mexico retain any mandatory rights to bring claims before competent local courts or consumer protection authorities.
17.4 Alternative Dispute Resolution
VitaJuwel may offer informal dispute resolution or alternative dispute resolution procedures by mutual agreement where legally permitted.
These Terms do not establish a mandatory arbitration agreement or class-action waiver.
18. Changes to These Terms
We may update these Terms to reflect legal, operational, or technical changes.
The current version will be published on our website with its effective date.
Updated Terms generally apply prospectively and do not retroactively change the conditions of an already concluded purchase, except where permitted by law and agreed upon where required.
Material changes will be communicated where legally necessary.
19. General Provisions
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
These Terms, together with applicable order details and any properly incorporated product-specific disclosures or policies, form the contractual framework for the relevant purchase.
Where mandatory consumer law conflicts with these Terms, the mandatory provision prevails.
Electronic communications and transaction documents may be used where legally permitted.

20. Additional Terms for Canadian Consumers
These provisions apply to consumers purchasing VitaJuwel products for delivery in Canada.
20.1 Mandatory Consumer Protections
Canadian consumers retain all rights afforded by applicable federal and provincial consumer protection legislation.
These may include statutory warranties, legal guarantees, cancellation rights, and remedies for defective, misrepresented, or undelivered goods.
Nothing in VitaJuwel's Final Sale Policy, voluntary warranty conditions, or liability provisions limits consumer protections that cannot lawfully be waived.
20.2 Prices and Cross-Border Charges
Prices and the final transaction currency will be disclosed before purchase.
Applicable shipping charges, taxes, and import-related costs will be handled according to the selected shipping arrangement and applicable legal requirements.
20.3 Quebec Consumers
Consumers in Quebec benefit from additional protections under the Civil Code of Québec, the Consumer Protection Act, and applicable language legislation.
These protections include statutory legal warranties and specific rules for distance contracts, including required disclosures, contract documentation, and cancellation rights.
Where required by applicable law, the French version of the contract and related documents will be made available before a consumer chooses to contract in another language.
Any choice of another contractual language must comply with the applicable requirements.
Nothing in these Terms requires Quebec consumers to waive mandatory legal warranties, statutory cancellation rights, or access to legally available remedies.
20.4 Voluntary VitaJuwel Protection Programs
Eligible Canadian consumers purchasing directly through vitajuwel.com may benefit from the VitaJuwel 2-Year Limited Warranty and 5-Year Worry-Free Replacement Policy, subject to the conditions stated in the respective policy documents.
These voluntary benefits do not replace Canadian statutory consumer protections.
20.5 Dispute Resolution
Canadian consumers retain any mandatory rights to bring disputes before competent Canadian courts or consumer protection authorities.
21. Additional Terms for Mexican Consumers
These provisions apply to consumers purchasing VitaJuwel products for delivery in Mexico.
21.1 Mandatory Consumer Protections
Mexican consumers retain all rights available under the Ley Federal de Protección al Consumidor (Federal Consumer Protection Law) and other applicable legislation.
These include any mandatory rights concerning contract information, delivery, cancellation, product conformity, warranties, and refunds.
21.2 Prices, Currency, and Import Charges
The final transaction currency, total amount payable to VitaJuwel, and applicable shipping charges will be disclosed before order submission.
Import duties, customs charges, and related costs will be handled in accordance with the shipping arrangement disclosed at checkout and applicable law.
21.3 Statutory Cancellation and Revocation Rights
Notwithstanding our general Final Sale Policy, Mexican consumers retain any statutory right to revoke consent or cancel a qualifying transaction under Article 56 of the Federal Consumer Protection Law or other applicable legislation.
Where such rights apply, VitaJuwel will honor valid requests and provide the legally required refunds or other remedies.
21.4 Warranty and Product Complaints
Mexican consumers retain applicable statutory rights concerning defective products, nonconforming goods, and warranty claims.
Eligible direct purchases through vitajuwel.com may also qualify for VitaJuwel's voluntary 2-Year Limited Warranty and 5-Year Worry-Free Replacement Policy, subject to the respective policy conditions.
These voluntary programs do not replace mandatory Mexican consumer rights.
21.5 Consumer Authorities and Disputes
Nothing in these Terms prevents Mexican consumers from exercising legally available rights before competent courts or consumer protection authorities, including the Procuraduría Federal del Consumidor (PROFECO).
21.6 Language
Contractual and transactional information will be made available in Spanish to the extent required by applicable Mexican law.
